This Privacy Policy applies to all information collected through our website www.lmntax.com and/or any related services, sales, marketing, or events (we refer to them collectively in this Privacy Policy as the “Services”).

IMPORTANT NOTICE FOR TAXPAYERS: Federal law, including the Internal Revenue Code (IRC) Section 7216 and the Gramm-Leach-Bliley Act (GLBA), imposes strict limitations on how tax return information may be used and disclosed. We do not sell your tax return information.

1. WHAT INFORMATION DO WE COLLECT?

Personal Information You Disclose to Us In Short: We collect personal information that you provide to us. We collect personal information that you voluntarily provide to us when registering at the Services, expressing an interest in obtaining information about us or our products and services, when participating in activities on the Services, or otherwise contacting us. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect can include the following:

  • Name and Contact Data (Email, Phone, Address).
  • Credentials (passwords and security information used for authentication).
  • Tax Return Information: If you engage us for services, we collect Social Security Numbers (SSNs), Taxpayer Identification Numbers (TINs), income data, and other financial data required for tax preparation.

Information Automatically Collected In Short: Some information such as IP address and/or browser and device characteristics is collected automatically when you visit our Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, and information about how and when you use our Services.

2. HOW DO WE USE YOUR INFORMATION?

General User Data (Non-Tax Data): We use personal information collected via our Services for legitimate business purposes described below:

  • To send you administrative information (e.g., changes to our terms or policies).
  • To protect our Services (fraud monitoring).
  • To enforce our terms and conditions.

Tax Return Information: We use Tax Return Information solely for the purpose of preparing and filing your tax return. WE DO NOT:

  • Sell your tax return information to third parties.
  • Share your tax return information with affiliates for marketing purposes without your express, written consent in compliance with IRS Section 7216.

3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations.

  • Service Providers: We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf (e.g., secure client portal hosting, tax software providers). These parties are bound by strict confidentiality agreements and federal law.
  • Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process (e.g., in response to a subpoena or IRS audit request).
  • Note on Privilege: Please be aware that unlike attorneys, communications with tax preparers are generally not protected by “privilege” in criminal legal proceedings. If we receive a valid subpoena or court order, we may be compelled to turn over records.

4. HOW LONG DO WE KEEP YOUR INFORMATION?

We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

  • Tax Records: In accordance with standard tax practices and IRS recommendations, we generally retain copies of tax returns and supporting documentation for a minimum of seven (7) years.

5. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. This includes encryption of data in transit and at rest, and multi-factor authentication, in compliance with the FTC Safeguards Rule. Communication Risk: You acknowledge that communication via standard email (lmntax@gmail.com) is not 100% secure. By communicating with us via email, you accept the inherent risks of data interception.

6. DO WE COLLECT INFORMATION FROM MINORS?

We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18.

7. YOUR PRIVACY RIGHTS (VIRGINIA & FEDERAL)

Federal Rights (GLBA): As a financial institution under the Gramm-Leach-Bliley Act, we provide you with a notice of our privacy practices. You have the right to limit some but not all sharing of information. Since we do not sell data or share with non-affiliates for marketing, your opt-out rights are generally satisfied by our default strict privacy practices.

Virginia Residents (VCDPA): If you are a resident of Virginia, you may have specific rights regarding access to your personal data. While LMN Tax Inc. may be exempt from certain entity-level requirements of the VCDPA due to our status as a GLBA-regulated entity, we are committed to transparency. You may request:

  1. To know whether we are processing your personal data.
  2. To access your personal data.
  3. To correct inaccuracies in your personal data.
  4. To request deletion of your personal data (subject to legal retention requirements for tax records).
  5. To obtain a copy of your personal data.

8. CALIFORNIA RESIDENTS (CCPA/CPRA)

If you are a resident of California, you are granted specific rights regarding access to your personal information.

  • Exemption: Much of the personal information we collect is “personal information collected, processed, sold, or disclosed pursuant to the federal Gramm-Leach-Bliley Act,” and is therefore exempt from the CCPA/CPRA.
  • For non-exempt data (if any), California residents have the right to request access to and deletion of their data.

11. SECURE CLIENT PORTAL AND TRACKING

Portal Security. Our client portal uses 256-bit encryption (HTTPS/TLS) for all data uploaded and downloaded. We offer optional Two-Factor Authentication (2FA) to portal users. The user is responsible for maintaining the confidentiality of their own login credentials and password.

Identity Verification. All portal accounts are manually verified by LMN Tax Inc. staff before access is granted. This is to prevent unauthorized individuals from accessing sensitive tax and financial documents.

Data Stored in the Portal. Documents uploaded to the portal are stored on servers secured by our hosting provider and are protected under the same confidentiality standards described in this Privacy Policy. We do not share portal files with third parties except as required by law or as described in Section 3.

Cookie & Analytics Disclosure. We use cookies and Google Analytics 4 (GA4) to monitor site usage and improve user experience. GA4 collects anonymized usage data such as pages visited and session duration. Users can manage cookie preferences through their browser settings or through the cookie consent banner on our site.
